This is the Privacy Policy for Unilease, LLC (referred to as “Unilease,” “Unilease.com,” “We,” “Our,” or “Us” herein).  This policy identifies the information We may collect from you or that you may provide Us when you visit www.unilease.com or any other websites managed by Unilease (collectively, the “Website”).  Please read and review these terms carefully so you understand Our policies regarding your information and how We manage your privacy. By accessing or using the Website, you agree to the terms of this Privacy Policy. We are committed to protecting and respecting your privacy.

This Privacy Policy will be applicable to the information We collect from you in all electronic forms, including your use of the Website, in email, text and other electronic communications between you and Unilease.  It will not be applicable to third parties who may provide Content (as defined in the Our Terms of Use) or to other websites and media which may be accessible through links found on the Website.

Information We Collect About You

We collect and process several types of information about you, which include:

1) Information you may provide Us from your use of the Website, including:

information you provide Us in your use of the Website, such as: your name, physical or mailing address, email address, or phone number(s).  We collect this information directly from you when you provide it to Us when you: i) register for or subscribe to Our services, ii) enter information or content on the Website, iii) send correspondence to Us, v) submit a query, or vi) provide information to Us in person or via telephone.

2) Information We automatically collect about you from your use of the Website, including:

information about your internet connection, technical information, information about your visit, IP location data, and information about your interaction with the Website including page view information, traffic data, and information about your computer, operating system, and browser.

The technologies we use for this automatic data collection may include:

  • Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting you may be unable to access certain parts of the Service. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to any website used as part of the Service.

  • Flash Cookies. Certain features of the Service may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on the Service. Flash cookies are not managed by the same browser settings as are used for browser cookies, and instead may be managed through your flash player settings.

The Website may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit Us, for example, to count users who have visited those pages and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

In addition, We may use cookies through the Website to understand User preferences, improve their experience, and track and analyze usage, and navigational and other statistical information.

No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, We may not respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that We must follow in the future, We will inform you about that practice in a revised version of this Privacy Policy.

3)  Information We collect from third parties.  

In the event that We collect any data or information from third parties, We will notify you when We collect such information if We intend to share the information or combine it with information or services on Our Website.  Our Website may have third party service providers who facilitate technical services, advertising services, analytics providers, or other third parties We choose to work with in connection with Our use and management of the Website and delivery of products, offers, or services to you.

How We Use Your Information

1) Information you provide to Us:

We use this information to manage your contract for services with Us, including: to administer your account, to facilitate and authenticate transactions, and to notify you about changes to your account or services.

We may also use this information to: i) present information and Content that you may request in connection with your services and transactions through Our services, ii) improve Our services and provide you assurances that your use of the Website and services are optimized and are delivered efficiently, iii) configure Our Website and other services in a manner consistent with your indicated preferences, iv) fulfill the obligations of Our service contract with you, including transactional obligations in billing and collections and; vi) for any other purpose you request, consent to, or receive pursuant to Our services and your use of the Website.

2)  Information we automatically collect about you from your use of the Website:

We use this information to: i) administer the Website, troubleshoot issues with the Website or Our services, analyze data, test services, and for research; ii) protect the security of the Website; iii) measure how efficiently Our services, offerings, advertisements, or aspects of the Website may be performing; iv) to improve our Website or services; and v) so you can participate in services offered on or via links found on the Website.

3)  Information We collect from third parties:

We may combine information you provide to Us or information We automatically collect about you from your use of the Website, with information We collect from third parties in providing services to you through the Website.

We will only use your information in ways that are compatible with the limited purpose for which it was collected and subject to any privacy filters you determine when you provide Us with Content, unless you specify authorize Us to use it otherwise.  In the event that We ever intend to use your information for any other purpose besides what We collected it for, or if We alter Our services in a way that may change how We use your information, or make other changes to Our services that materially affect your privacy preferences on the Website, We will provide you with the advance notice of changes in our Privacy Policy, at which point you may elect to modify your services with Us based on Our then current service offerings, or cancel your account with Us pursuant to the terms of your agreements with Us. 

In conjunction with Our services, We aggregate anonymous data and Content you provide to Us (subject to your privacy preferences when you submit Content to Us).  Additionally, We may disclose information that We collect to:  i) our subsidiaries and affiliates, ii) third party contractors and service providers We may employ or utilize to facilitate our services, provided such third parties are bound contractually to keep personal information confidential and only use if for the purposes for which it may be disclosed, iii) to any potential third party who may be an investor, or acquirer of Our company, a merger prospect, or other third parties who may have other private interests in Our company, or other interests by way of divestiture, bankruptcy, winding down, or other proceeding in which information about you and our users is among the assets being transferred, iv) to fulfill any purpose for which the information is provided to Us or disclosed to you when you provide the information, v) for those purposes where We have your consent, vi) in compliance with any legal proceeding, court order, lawful purposes or any regulatory or governmental inquiry or request, vii) to enforce Our Terms of Use and other agreements We may have with you, or viii) for any disclosure that may be necessary or appropriate to protect the rights, property or safety of Unilease, Our users, or third parties.

Public Forums, Venues and Message Boards

We may, at Our discretion, make available public forums including message boards, chat rooms, or other public forums for visitors and users.  Any information disclosed in such public forums will be publicly available and you must exercise caution when using and posting on these public forums.

Transfer of Information to Us Via Secure Socket Layer (“SSL”)

All information you provide to Us is stored on Our servers and the transfer of any data to Us will be made via secure socket layer (“SSL”) technology, including information that may relate to payment information.

The transmission of information over the internet is not completely secure.  Although We take efforts to protect your personal information, We cannot guarantee the security of your information transmitted to the Website over the internet.  Any transmission of personal information or Content is made at your own risk.  

Storing Your Information 

We keep your information while you have an active account with Us, while you have an interest in our products and services, and as long as We may need to fulfil our contractual obligations to you.  Further, We may retain such information for a period of up to seven (7) years following your termination of services, termination of interest (or opt-out), or termination of your contractual obligations with Us.  We may also retain aggregated, anonymous information indefinitely for research and development purposes.

The data that We collect from you may be stored in the USA and in the European Economic Area ("EEA"). Data that is transferred to, or stored at, a destination outside the EEA may not be subject to equivalent Data Protection Law. Where your personal information originates in the EEA or Switzerland and is transferred outside the EEA, We will take all steps reasonably necessary to ensure that your data is subject to appropriate safeguards, such as relying on a recognized legal adequacy mechanism, and that it is treated securely and in accordance with this Privacy Policy. To comply with European Union and Swiss data protection laws, Unilease self-certified under the E.U.-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield.

If your personal data or information originates in the EEA, we may transfer it outside of the EEA: i) in order to store it, ii) in order to enable Us to provide products and services to you to fulfill Our contractual obligations with you, iii) where We are legally obliged to do so, and; iv) in order to facilitate the operation of Our business practices where Our legitimate interests are not overridden by your rights.

We may transfer your personal information and data to the following countries outside of the EEA:  i) United States - Unilease is E.U.-U.S. and Swiss-US Privacy Shield Certified so this is treated as a transfer to an ‘Adequate Country’ for EU and Swiss data protection purposes.

Content Accuracy & Privacy

In your use of the services of the Website, you agree to only provide accurate Content, and you may determine the privacy settings of such Content and how, and with whom, it is shared pursuant to the features, permissions and restriction settings that may be offered on the Website.  We reserve the right to remove falsified Content or take other actions as We deem appropriate to preserve the aggregated collective accuracy of such Content, subject to our Terms of Use.  

EU Citizen / General Data Protection Regulation (“GDPR”)

The data, information, and Content submitted to Unilease is known as “Data and Information.”  Under the GDPR, Unilease is a Data Processor of the Data and Information.  Unilease users are the Controllers of Data and Information and are responsible for all Controller obligations, such as choosing the appropriate legal basis for collecting and using all personal data.  

1) Data controlling and the GDPR 

We collect, store, and process business contact data (used for direct marketing, demonstrations, and business development, among other things) and user usage data (used for internal analytics, user experience tracking, and marketing purposes.)  Under the GDPR, We are a Data Controller with regards to business contact data and user usage data.  Business contact data is obtained by Us on the basis of your consent (where you affirmatively provide it to Unilease, for example when requesting a product demonstration) or for Our legitimate interest in responding to your inquiries, providing Our services to you, assisting you in your use of the services, and otherwise communicating with Our users, customers, and Our potential customers.  User usage data is obtained for Our legitimate interest of providing customer support, improving Our services, and communicating with Our customers or potential customers. 

Individuals can opt out of allowing Us the use of their business contact data at any time by submitting a request to privacy@unilease.com. 

User usage data is a part of our services. Therefore, when a user would like to opt-out of collection of usage data, the user will no longer be able to use Our services.  

2) Information Access & Corrections

Whether it’s the GDPR, the California Consumer Privacy Act of 2018, or other statute, We are committed to complying with all applicable law regarding the handling of personal information. Unilease operations are based in the United States, which is the geographic location for all of Our data processing. You can review and change your personal information by logging into your account and visiting your account profile page, or by sending Us an email at privacy@unilease.com to request access to, correct, or delete any personal information that you have provided to Us.

3) Your Privacy Law Data Rights

You have the right under certain circumstances to: i) be provided with a copy of your personal data and information held by Us, ii) request the correction of your personal data and information, iii) request the deletion of your personal data and information, iv) request the restriction of the processing of your personal data for a specific purpose (by way of example, while We investigate your concerns), v) object to the further processing of your data and information, including the right to object to marketing, and; vi) to request your personal data in machine readable  ‘open-format’; and v) to withdraw consent to processing your personal data.  At any time you may exercise one or more of these rights by emailing Us at privacy@unilease.com and requesting the specific action(s) that you would like Us to take regarding your personal data.

Access Codes & Passwords

Where We have given you an access code to access the Website, or you have chosen a password for your account (as applicable), you are responsible for keeping any access codes and passwords confidential.  You may not share your passwords or access codes with anyone.  

Changes to This Privacy Policy

We reserve the right to make changes to this Privacy Policy at any time and at Our sole discretion.  We will post any changes We make to Our privacy policy on our Privacy Policy page. If We make material (in Our sole discretion) changes to how We treat our users’ personal information, or material (in Our sole discretion) changes how We treat the Content you provide Us, We will notify you either by email to the email address specified in your account and/or through a notice on the Website. The date that this Privacy Policy was last revised is identified at the top of this page. You are responsible for ensuring We have an up-to-date active and deliverable email address for you, and for periodically visiting our Website and this Privacy Policy to check for any changes. Any use of the Website or Our services after the posting of an update to Our privacy policy constitutes your acknowledgement and acceptance of the updated policy.

Account Changes & Deletions

We cannot delete all of your personal data and information without also deleting your account.  We reserve the right to refuse any request to change your account information if We believe any requested change may violate any law or legal requirement, or otherwise cause your information to be incorrect or inaccurate.
